Introduction

Hey Mate LLC, an Arizona limited liability company ("Hey Mate", "we", "us" or "our"), respects your privacy. This Privacy Policy explains what information we collect when you visit yerbaheymate.com and any related site, store, email or text program we operate (together, the "Site"), how we use it, who we share it with, and the choices you have.

By using the Site you agree to this Privacy Policy and to our Terms of Use. If you do not agree, please do not use the Site.

Purchases made on Amazon or through other retailers are governed by that retailer's own privacy policy, not this one.

Information we collect

Information you give us

• Contact details, such as your name, email address, phone number, and shipping and billing address, when you join our list, place an order, create an account, enter a promotion or contact us.
• Order and subscription details, such as the products you buy, your subscription schedule, and your order, shipping and return history.
• Payment information. Payments are processed by our payment processor, Stripe. Your full card number goes directly to Stripe and is not stored by us. We receive limited details such as the card brand, the last four digits and the expiration date. See Stripe's privacy policy at stripe.com/privacy.
• Messages and feedback, such as customer service requests, survey answers and product reviews.

Information collected automatically

• Device and usage data, such as your browser and device type, operating system, the pages you view, the links you click, the time and date of your visit, the site that referred you, and your approximate location derived from your IP address. Our web servers may record IP addresses in routine logs used for security and troubleshooting.
• Cookies, pixels and similar technologies. See "Cookies, pixels and advertising" below.

Information from others

• Advertising and social media platforms, such as Meta (Facebook and Instagram), may tell us how our ads performed, for example that someone who saw an ad later visited the Site, usually in aggregated form.
• Service providers, such as shipping carriers, may give us delivery and address updates.

How we use your information

We use information we collect to:

• Process and deliver orders and subscriptions, handle payments, returns and refunds, and calculate sales tax.
• Send you the updates and offers you signed up for, including launch news and promotions.
• Respond to your questions and provide customer service.
• Operate, secure and improve the Site, and understand which pages and products people find useful.
• Measure and improve our advertising, and show you Hey Mate ads on other sites and apps.
• Run promotions, contests and surveys you choose to enter.
• Prevent fraud, abuse and security incidents.
• Comply with law, enforce our Terms of Use and protect our rights and the rights of others.

Cookies, pixels and advertising

We use cookies and similar technologies to make the Site work, to understand how it is used, and to advertise.

• Meta Pixel. We use the Meta Pixel, a tool from Meta Platforms, Inc., to record when visitors view pages and when they sign up or buy, so we can measure our ads and show Hey Mate ads to people on Facebook and Instagram. Meta may combine this with other information it holds about you under Meta's own privacy policy. You can control the ads you see in your Facebook and Instagram ad settings.
• Google Analytics. We use Google Analytics, a service from Google LLC, to understand how visitors find and use the Site, such as the pages they view, how long they stay and the site that referred them, and to count sign-ups. Google Analytics uses cookies and receives your IP address, which it uses to estimate your general location. We look at these reports in aggregate to improve the Site. Google handles this information under its own privacy policy (policies.google.com/privacy); you can read how Google uses data from sites that use its services at policies.google.com/technologies/partner-sites. You can opt out of Google Analytics on any website with the Google Analytics Opt-out Browser Add-on (tools.google.com/dlpage/gaoptout). We may add other analytics or advertising tools in the future; when we do, we will update this policy.

Your choices. You can block or delete cookies in your browser settings; parts of the Site may not work without them. You can opt out of interest-based advertising from many companies through the Network Advertising Initiative (optout.networkadvertising.org) and the Digital Advertising Alliance (optout.aboutads.info).

Global Privacy Control. If your browser sends a Global Privacy Control (GPC) signal, the Site does not load the Meta Pixel or Google Analytics for that browser, and we treat the signal as a request to opt out of targeted advertising. Browsers' older "Do Not Track" setting has no agreed standard, so we do not respond to it separately.

Text messages

If you opt in to receive text messages from Hey Mate, we will use your mobile number to send the messages you asked for, such as order and shipping updates, customer service replies and, if you agreed to them, promotions. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. Consent to receive texts is not a condition of any purchase. We do not share your mobile number or your text messaging opt-in with third parties or affiliates for their marketing purposes.

How we share information

We do not sell your personal information for money. We share information only as follows:

• Service providers that work for us, such as our payment processor, e-commerce, database and website hosting providers, email and text messaging services, fulfillment and shipping partners, customer service tools, and analytics providers such as Google Analytics. They may use your information only to provide services to us.
• Advertising partners, such as Meta, through the Meta Pixel described above. Under some state laws this is considered "sharing" for targeted advertising, which you can opt out of as described under "Your privacy rights".
• Our fulfillment partner. Orders shipped from our warehouse are handled by our storage and fulfillment provider, which receives the name, address and order details needed to ship them.
• Legal and safety reasons, when we believe disclosure is required by law, legal process or a government request, or is needed to protect the rights, property or safety of Hey Mate, our customers or others, including to prevent fraud.
• Business transfers. If Hey Mate is involved in a merger, acquisition, financing, reorganization or sale of assets, your information may be transferred as part of that transaction. We will require the recipient to honor this Privacy Policy.
• Investors and financing. We may share information with our investors, prospective investors, lenders and their professional advisors for general business analysis, and in connection with due diligence for a financing, acquisition or similar transaction. They receive it subject to confidentiality obligations, and we share it in aggregated or de-identified form where practical.
• With your consent or at your direction.

We may share information that has been aggregated or de-identified so it no longer identifies you.

Your privacy rights

Depending on where you live, you may have the right to:

• Know and access the personal information we hold about you.
• Correct inaccurate information.
• Delete your information.
• Receive a copy of your information in a portable format.
• Opt out of targeted advertising and the "sale" or "sharing" of your information.

We honor these requests from all of our customers, wherever they live. To make a request, email us at [email protected] with the subject "Privacy request". We will verify your request by confirming it from the email address we have on file, and we will respond within 45 days. You may use an authorized agent; we may ask for proof of the agent's authority. If we deny your request, you may appeal by replying to our decision, and we will respond to the appeal within 45 days. We will not discriminate against you for exercising any of these rights.

Marketing emails. Use the unsubscribe link in any marketing email. We may still send messages about your orders and account.

California residents. Under California Civil Code Section 1798.83 ("Shine the Light"), you may ask once a year which personal information, if any, we disclosed to third parties for their own direct marketing during the prior year. We do not make such disclosures.

Data retention

We keep personal information only as long as we need it for the purposes in this policy: for example, for as long as you stay on our list or keep an account, and for order records, for as long as tax, accounting and legal requirements call for. We then delete it or keep it only in de-identified or aggregated form.

Security

We use administrative, technical and physical safeguards to protect your information, including encryption in transit (HTTPS) and access controls. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

Children

The Site is intended for adults and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has given us personal information, contact us and we will delete it. You must be at least 18 years old, or the age of majority where you live, to make a purchase.

Third-party sites

The Site may link to other websites, such as Amazon, social media and our retail partners. Their privacy practices are their own, and we encourage you to read their policies.

Visitors outside the United States

Hey Mate is based in the United States, and the Site is operated from the United States. If you visit from another country, your information will be processed in the United States, where privacy laws may differ from those in your country.

Disputes

Any dispute about this Privacy Policy is subject to the dispute resolution, arbitration and class action waiver provisions of our Terms of Use.

Changes to this policy

We may update this Privacy Policy from time to time. We will post the new version on this page and change the "Last updated" date. If we make material changes, we will give you more prominent notice, such as an email to subscribers or a notice on the Site.
